These Terms of Use ("Agreement") set out the terms and conditions under which you may access and use information, tools, features and functionality located on www.bankwiser.eu and all related subdomains, including the Bankwiser community and blog (collectively, the "Service"), whether you are “a Visitor” or you are a registered “User“. The term “you” or “User” refers to both Visitors and Users. We recommend that User thoroughly reviews this Agreement, as the same may be updated from time to time, before accessing or using the Website. User must not access and use the Website if User doesn’t agree to all of the terms and provisions of this Agreement. The Service is provided, controlled and operated by Codeware OÜ, registered in Tallinn, Estonia under the registration number 16643846 with its registered address at Rõugu 2/2-12, Tallinn, Estonia, 13522.

1. Description of the Service

The Service is a personal finance information management service that allows Users to consolidate and track their financial information on www.bankwiser.eu. Based on such information, the Service may also present information relating to third party products or services. The Service is provided to you as an aid to assist you in organizing and managing your finances. It is not intended to provide legal, tax or other professional advice or service.

2. Privacy and your Personal Information

Bankwiser will not sell, exchange, or release any of your information or financial information to a third party without your express permission or as required by law or court or governmental order. For information about our data protection practices, please read Privacy Policy, which is hereby incorporated into this Agreement. The policy may be updated from time to time at our discretion. Changes will be effective upon posting to the site.

3. Registration

Your account must be registered by a human. Accounts automatically registered by "bots" or other methods are not permitted. Additionally, you must be 16 years of age or older to register for Bankwiser.

You agree and understand that you are responsible for maintaining the confidentiality of your password which, together with your e-mail address allows you to access the Service. By providing us with your e-mail address, you agree to receive all required notices electronically, to that e-mail address. It is your responsibility to update or change that address, as appropriate. If you become aware of any unauthorized use of your Registration Information, you agree to notify us immediately at the email address info[at]bankwiser.eu.

4. Your Use of the Service

Your right to access and use our website and the Service is personal to you and is not transferable by you to any other person or entity. You are only entitled to access and use our site for lawful purposes. The Service is most effective when accurate information is supplied. You must provide true, accurate, current, and complete information about your accounts maintained at other web sites and you may not misrepresent your Registration Information. In order for the Service to function effectively, you must also keep your Registration Information up to date and accurate. Obviously, failure to do so will affect the accuracy and effectiveness of the Service.

Your access and use of our site may be interrupted from time to time for any of several reasons, including without limitation the malfunction of equipment, periodic updating, maintenance or repair of our site, or other actions that we, in our sole discretion, may elect to take.

The contents of our site belong or are licensed to us or our software or content suppliers. We grant you the right to view and use the Service subject to these terms. You may download or print a copy of information provided on our site for your personal, non-commercial use only. Any distribution, reprint, or electronic reproduction of any content from our site in whole or in part for any other purpose is expressly prohibited without our prior written consent. All rights not granted are exclusively reserved by us. This is not a transfer of ownership in any intellectual property owned by us.

7. Access and Interference

You agree that you will not:

• Use any robot, spider, scraper or other similar automated data gathering or extraction tools, program, algorithm or methodology to access, acquire, copy, or monitor the Service or any portion of our site without our express written consent, which may be withheld in our sole discretion;
• Use or attempt to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search our site, other than the search engines and search agents available through the Service and other than generally available third-party web browsers (such as Internet Explorer, Safari, Firefox, Chrome, or Opera);
• Post or transmit any file that contains viruses, worms, Trojan horses, or any other contaminating or destructive features, or that otherwise interfere with the proper working of our site or the Service; or
• Attempt to decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of our site or the Service.

8. Rules for Posting

As part of the Service, we may allow Users to post content on bulletin boards, blogs, and at various other publicly available locations on our site. You agree in posting content to follow certain rules:

• You are responsible for all content you submit to our site;
• You may not post or transmit any message that is libelous or defamatory, or that discloses private or personal matters concerning any person. • Except where expressly permitted, you may not post or transmit charity requests; petitions for signatures; franchises, distributorship, sales representative agency arrangements, or other business opportunities (including offers of employment or contracting arrangements); club memberships; chain letters; or letters relating to pyramid schemes. • You may not copy or use personal identifying or business contact information about other Users without their permission. Unsolicited emails, mailings, telephone calls, or other communications to individuals or companies whose contact details you obtain through the Service are prohibited.

9. Social Media

We may provide experiences on social media platforms such as Facebook®, Twitter®, and LinkedIn® that enable online sharing and collaboration among Users who have registered to use them. Any content you post, such as pictures, information, opinions, or any personal information that you make available to other participants on these social platforms, is subject to the Terms of Use and Privacy Policies of those platforms. Please refer to those social media platforms to better understand your rights and obligations with regard to such content.

10. Termination

This Agreement will remain in effect until terminated by either you or us as set out below. If you want to terminate your agreement with us, you may do so by closing your account for the Service.

We may at any time terminate our legal agreement with you immediately upon notice to the email address provided by you as part of your Registration Information:

• If you have breached or repudiated any provision of this Agreement; or
• If we in our sole discretion believe termination is required to do so by law.

11. Limitations on Bankwiser’s Liability

BANKWISER SHALL IN NO EVENT BE RESPONSIBLE OR LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, LIQUIDATED OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE OR BUSINESS, ARISING IN WHOLE OR IN PART FROM YOUR ACCESS TO WWW.BANKWISER.EU, YOUR USE OF THE SERVICE OR THIS AGREEMENT, EVEN IF BANKWISER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Modifications and Miscellaneous

Bankwiser may modify this Agreement from time to time. Any and all changes to this Agreement will be posted on the www.bankwiser.eu site. In addition, the Agreement will always indicate the date it was last revised. You are deemed to accept and agree to be bound by any changes to the Agreement when you use the Service after those changes are posted.

All covenants, agreements, representations and warranties made in this Agreement shall survive your acceptance of this Agreement and the termination of this Agreement.

This Agreement represents the entire understanding and agreement between you and Bankwiser regarding the subject matter of the same, and supersedes all other previous agreements.
